We checked 1,112 Power to Choose listings against their EFLs; 79 differ (October 9, 2026)
On October 9, 2026, we compared 1,112 active Power to Choose listings with each plan's own Electricity Facts Label (EFL). For 79 listings (7.1%), the price, contract term or cancellation fee on the EFL differs from the listing; for 1,033 we found no difference. Before you sign, check the EFL, which is the document that governs the plan.

On October 9, 2026, we compared 1,112 active Power to Choose listings with the Electricity Facts Label (EFL) of each plan. For 79 listings (7.1%), at least one of three things on the EFL differs from the listing: the average price, the contract term or the cancellation fee. This article describes what we compared and what we found. It does not say why any listing and EFL differ, and it makes no claim about anyone's intent.

What we found

All counts are for the data day October 9, 2026. The denominator is the 1,112 active listings; every one of them had a readable EFL fetched within the last 7 days from the link Power to Choose gives.

The 85 differences are spread over 79 listings because 6 listings differ in two fields. A listing is one Power to Choose entry; many plans are listed once per utility and again in Spanish, so one plan can account for several listings.

Of the 60 price differences, the EFL's average price at 1,000 kWh is higher than the listing's in 42 and lower in 18. The largest gap at any of the three points (500, 1,000 and 2,000 kWh) is 1.5¢ per kWh, and 31 of the 60 are 0.2¢.

Of the 24 term differences, 20 are listings that show 10 months where the EFL says 9 months. The others are one listing showing 60 months (EFL: 12 months), one showing 9 months (EFL: 6 months), one showing 10 months (EFL: month-to-month) and one showing 3 months (EFL: month-to-month).

How we check

We hold the EFL for each active listing, downloaded from the link Power to Choose gives for that listing, and we read it with a rule-based reader (no AI model). A listing is checked only if that EFL was fetched within 7 days. We count a difference only when every test for that field passes:

  • Price. The EFL prints average prices at 500, 1,000 and 2,000 kWh. We round them to 0.1¢, the precision Power to Choose uses. A price difference counts only if the EFL differs from the listing by more than 0.15¢ per kWh at one or more of the three points, which means 0.2¢ or more, so a rounding difference alone never counts. The EFL must name only the listing's utility, and the charges on the EFL must rebuild its own printed prices.
  • Contract term. Every contract-term statement on the EFL gives the same length, and it differs from the listing. Month-to-month is treated as 1 month; Power to Choose lists it as 0 or 1.
  • Cancellation fee. Every termination-fee statement on the EFL names the same dollar amount, and it differs from the listing.
  • Left out. A listing whose English and Spanish EFL links carry different versions is not counted, and neither is any case our rules cannot confirm. On October 9, 2026, that was 2 cases.

We treat the EFL as the binding document for a plan, because it is the provider's own official statement of the plan's price and terms. The line we show for each case is text extracted automatically from the EFL, so it may drop or double letters. When we reviewed our first results, we found one case where our reader, not the listing, was wrong: a PDF that draws bold text twice was read as 88 months when the EFL says 8 months. We fixed the reader and re-checked, and that listing is not counted.

  • Atlantex Power, Luminous 9 (Oncor): the listing shows a 10-month term and the EFL says 9 months.
  • Spark Energy, Choose 6 (Oncor): the EFL's prices are 0.2¢ per kWh higher than the listing at each of the three points. EFL.
  • Cleansky Energy, Embrace Green 12 - New Customer Special (Lubbock Power & Light): here the listing is 0.8¢ per kWh higher than the EFL. Differences go in both directions.
  • Champion Energy Services, Free Weekends-24 (Lubbock Power & Light): the listing shows a $150.00 cancellation fee and the EFL states $250.00. This is the only cancellation-fee difference in this check.

Each plan's page on our site shows the same figures: for example Atlantex Power Luminous 9 on Oncor and Spark Energy Choose 6 on Oncor.

The table lists the 15 providers with at least one listing that differs, in alphabetical order. The full table for all 44 providers is on the data page. Counts depend on how many listings a provider has and on how many utilities and languages each plan is listed in, so they are not a ranking.

What it means for shoppers

  • Check the EFL before you sign. The listing is a summary; the EFL is the plan's own statement of price and terms. Compare the average prices at 500, 1,000 and 2,000 kWh, the contract term and the cancellation fee on the EFL with what the listing showed.
  • Use your own usage. Average prices at the three usage points are not your bill. Our Texas electricity rates pages estimate 12-month cost on your usage, using the same data.
  • If a figure differs, ask the provider which one applies to the plan you are enrolling in, and keep a copy of the EFL you were given.

What it does not mean

  • We make no claim about intent, and we do not say which document came first or why they differ.
  • A listing can lag behind an EFL update, and some differences may be corrected later. We re-run the check with each daily import, so counts change.
  • The 7.1% is a count of the listings on one day. It does not describe how a provider treats its customers, and we do not rank providers.
  • Our reader can make mistakes. We found and fixed 1 of our own, and we leave out cases we cannot confirm.

Data, and how providers can ask for a correction

The listing accuracy data page lists every case with the provider, plan, utility, both values, the EFL line we read and the link to the EFL. The data is also available as CSV and JSON, and through our API.

A provider that thinks a case was read incorrectly can send us the listing ID and the EFL through our contact page. If a listing or our reading is corrected, we update the data after the next import.

Texas electricity rates in October 2026: what our data shows

As of October 2026, our data lists 952 distinct residential plan offers (1,107 listings before combining English/Spanish duplicates of the same plan) from 44 provider brands across Texas's competitive utility areas. For a home averaging 1,000 kWh a month on a seasonal profile, the lowest estimated annual cost for a fixed-rate plan ranges from about $1,323 (AEP Texas Central) to about $1,464 (Oncor), and the cheapest-looking plans at 1,000 kWh mostly rank far lower once a full year is counted.
