These terms apply to the TexasHomeBills™ JSON API (/api/v1), the MCP server (/mcp), API keys and the data files offered with them (together, the "API"). TexasHomeBills™ ("we", "us") operates the API. By calling the API or creating a key, you ("you") agree to these terms and to our Terms of Service. If these terms conflict with the Terms of Service, these terms control for the API.
1. Free non-commercial use, with attribution
You may use the API free of charge, with or without a key, within the limits in section 5, for personal, research, educational, news and other non-commercial purposes (see section 4 for commercial use). Individuals, journalists, researchers, students, nonprofits, and AI assistants and search engines that quote or summarize our pages with a link to them may use the free tiers. Attribution is a condition of every use, free or paid: whenever you show, quote or summarize data from the API, show your users the name "TexasHomeBills™" with a visible, clickable link to the url of the item you used (or to https://texashomebills.com). Every response includes an attribution block and a ready cite line for this purpose. Use without that attribution is not licensed.
2. Estimates, no warranty
The data come mainly from public sources (Power to Choose, the Public Utility Commission of Texas and each provider's Electricity Facts Label; for market and public data also ERCOT, the U.S. Energy Information Administration, the U.S. Bureau of Labor Statistics, NOAA NCEI, Austin Energy and CPS Energy) and from our own calculations. Values from those publishers are passed on as published, with gaps left empty and incomplete days flagged. Costs and rankings are estimates based on assumptions about usage; they exclude taxes and local fees and are not offers or quotes from any provider. Data may be delayed, incomplete or wrong. THE API AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. You must not present our estimates as offers, quotes or guarantees.
3. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM THE API OR THE DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE API IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE API IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US$50.
4. Commercial use
"Commercial use" means using data or output from the API in or to support a product, service, app, website, dataset or AI model (including training) that earns revenue or is offered by a business; doing work for clients with it; displaying it in a commercial product; or reselling or redistributing it in bulk. Examples: a comparison app or website showing our rankings or prices; a broker, retail provider or consultant using our data for customers or clients; a paid report, newsletter or dashboard built on our data; training or evaluating an AI model with our data. Not commercial use: a news article or an AI assistant's answer that quotes a figure with a link to our page; academic research, teaching or a nonprofit's consumer guide; a personal script for your own household.
Commercial use without an active Pro plan or a separate written agreement with us is not permitted. Free keys and keyless access are for non-commercial use only. Bulk downloads of historical data (the daily plan history and the history of the market and public data series) are also part of the Pro plan. Even with Pro, you may not resell access to the API, or sell, sublicense or mirror our datasets as a dataset, file or feed, or offer a service whose main purpose is to replace or mirror the API, without a separate written agreement. If we find use that breaks these terms, we may revoke keys, block access and take other steps available to us.
Public source data we compile — from government agencies such as the EIA, BLS, NOAA and the PUCT, and from ERCOT — remains free from its original publishers under their own terms. These terms cover our compilation, calculations and service, not the underlying public records. When you use market or public data, also credit the original publisher listed in the sources of each response.
5. Rate limits

Hourly windows reset at the top of each hour and daily windows at 00:00 UTC. Requests over a limit receive HTTP 429 and are not counted. You must not circumvent limits, for example by spreading requests over many IP addresses or keys. Without a Pro key, market and public data are limited to the most recent 30 days of each series, and a JSON response returns at most 5,000 rows (20,000 with Pro). We may change limits; we will post changes on the developer page.
6. Keys and security
Each key belongs to the account that created it. Keep keys secret: do not embed them in public code, web pages or apps that others can read. You are responsible for use of your keys. If a key leaks, revoke it from your account page. We store only a fingerprint of each key and cannot show it again. We may revoke keys that are abused or leaked.
7. Pro plan and commercial license
The Pro plan (US$99 per month or US$990 per year, plus any applicable tax) adds higher limits, the full daily plan history, the full history of the market and public data series, bulk files, and a license for commercial use of the data as defined in section 4, subject to attribution and the limits in section 4. Subscriptions renew automatically until canceled; you can cancel at any time from your account page (Cancel subscription). Pro stays active until the end of the period you paid for and then does not renew; there are no partial refunds for the rest of a period. You can undo a cancellation until that period ends. Payments are processed by Stripe through our aiSwingX™ account and appear on statements as aiSwingX™. Except where required by law, fees already paid are not refundable. We will give at least 30 days' notice of any price change, which applies from your next renewal.
7a. Provider Report
Provider Report (US$299 per month or US$2,990 per year, plus any applicable tax) is a report subscription for electricity providers and brokers: a watch list, daily alerts, a weekly report with PDF and CSV files, and a dashboard. It includes the Pro plan in section 7. First-time subscribers get a 7-day free trial; if you cancel before the trial ends you are not charged. One trial per account. Cancel any time; access continues to the end of the paid period; no partial refunds. Reports are built from public data and our own estimates as described on the Provider Report page. If an alert was wrong because of our error, tell us and we correct it within one business day.
8. Changes, suspension and termination
We may change, limit or discontinue any part of the API. We may suspend or terminate access, including revoking keys, if you breach these terms, abuse the service or put it at risk. You may stop using the API at any time. Sections 2, 3, 4 and 9 survive termination.
9. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Courts located in Texas have exclusive jurisdiction, except where the law of your place of residence requires otherwise.
